Lawyers in the firm’s Economic Law department advise and assist clients on competition, distribution, commercial and consumer contracts.
The department drafts terms and conditions of sale, negotiates distribution agreements, commercial agent agreements and agreements with other service providers.
Area of expertise
Drafting of service, sale, supply and outsourcing agreements, terms and conditions of purchase and sale, commercial partnerships, manufacturing and subcontracting agreements, business transfer and lease management agreements, etc.; termination of business relations.
Setting up distribution, franchise, commercial agency or dealership & concession agreements; protection of exclusive or selective distribution networks.
Regulation of retail sales and promotional operations (games, lotteries, bonuses); advertising, customer loyalty programs, distance sales, solicitation; consumer credit.
Anti-competitive practices (cartels and abuses of dominant position), representation before the French and EU competition authorities; assistance in the context of investigations or dawn raids by French or EU competition authorities or by the European Commission; conduct of antitrust audits and compliance programs; merger controls: feasibility studies, merger notifications to the French and/or EU authorities, management of multi-jurisdictional notifications; State aid; restrictions on competition; unfair competition (i.e., no-poaching agreements, denigration, parasitic conduct).
